to resolve their family law issues through Collaborative Law, an alternative
to the adversarial litigation system. Attorney Debra Denison Cantor
is trained in the collaborative law process and can represent clients
in this alternate dispute resolution process.
In collaborative law the attorneys for both parties are trained to
assist the parties in a family law dispute to resolve issues in a
positive environment, using a cooperative approach. It is an alternate
dispute resolution process, which allows the parties to avoid going
to court, while still receiving the support and expertise of their
own family law attorney. The collaborative law process is empowering,
informative and less stressful than court. The clients are in charge
and control the pace and most importantly the ultimate outcome of
each particular issue that needs to be resolved. The parties and their
respective lawyers work as a team where the future and well being
of each client and the family is the number one goal. The parties
and attorneys sign an agreement at the onset of the process to cooperate
in a complete and honest exchange of information in an informal setting.
The parties and counsel meet in a series of informal four party conferences
where the parties set the agenda and work together with their counsel
to problem solve the needs of their particular family. The collaborative
lawyers are committed to finding constructive ways to achieve a settlement
that will work best for that particular case, and not function as
adversaries. The lawyers and the parties have a strong incentive to
succeed; if the case cannot be resolved, and litigation becomes necessary,
the lawyers must withdraw from the case and cannot continue to represent
the client in court, and the parties are free to hire new attorneys
to pursue the matter in court. The collaborative law process works
if problem solving is more important than fighting, and the client
wants a solution that is fair to both parties.
